Access Problem Reporting Form

Over the years a number of members have reported access problems to the MCofS, and whenever possible the staff and volunteer office bearers have followed up these reports. Since the implementation of the Land reform Act in February 2005, all Scottish local authorities have dedicated Access officers whose remit includes addressing and resolving access disputes and issues in their areas. The MCofS will continue to help in resolving access problems. Success in dealing with these is quite often dependent on the quality of the original information reported to us. For instance, we are unable to challenge and negotiate effectively if we have been given inaccurate or incomplete details about an access situation. A lack of basic details does occasionally prevent us from being able to investigate an incident, so in order to improve the quality of information that is sent to us, we have produced this Access Problems Reporting Form. Use the following guidance notes to help you fill in that section of the form asking you to describe the problem, and give as many details as you can.

  • Describe the problem as clearly as possible. In the case of a sign, please give the exact wording, and forward a photograph if at all possible.
  • If you have been confronted or threatened, give whatever details you can about the person, or people, you spoke to. If possible give their names or a description of what they looked like, and describe their vehicle and its number plate. Tell us anything else that you found out about them, such as who they represented? Try and recount as accurately as possible what was said.
  • If an access route was blocked, try to give some idea of the scale of the blockage. For example, the height or length of fencing, the amount of barbed wire, or the density of trees.
  • It is also helpful if you can tell us if you have been in the area before, and if so, whether you have personally experienced a problem before.

Describe the Problem

It is helpful if you let us know if you have complained direct to the landowner or anyone else that might be involved (e.g. SNH or the local Council). We may be interested in seeing copies of any correspondence if you have already made contact elsewhere.
